During his latest press conference, President Andrzej Duda sharply criticized the actions of Donald Tusk’s government and Prosecutor General Adam Bodnar, emphasizing that they constitute a flagrant violation of the law and the Constitution. Duda expressed regret that despite obvious violations of the rule of law, European institutions, headed by the European Commission, remain passive, which he attributes to the political ties between President Ursula von der Leyen and Tusk.
It is difficult to describe what is currently happening in the Polish legal system in any other way than as a crisis of the rule of law. The attempt to dismiss Dariusz Barski from the position of National Prosecutor and the appointment of Dariusz Korneluk was an action without any legal basis, as confirmed by the Supreme Court’s judgment. This is a scandalous violation of the Act on the Prosecutor’s Office, as well as the Constitution, which cannot be ignored.
Duda rightly raises the issue of hypocrisy of European institutions, which during the previous government were exceptionally active in criticizing alleged violations of the rule of law, and now pretend that nothing is happening. The European Commission, which daily proclaims slogans about the rule of law and democracy, turns a blind eye to the lawlessness that is being implemented in Poland under the umbrella of the Tusk government.
The lack of reaction from the European Commission to what is happening in Poland raises questions about double standards in the European Union. The legal actions against Dariusz Barski, despite being completely contrary to the Constitution, have not been met with any reaction from Brussels. This shows how political connections and loyalties can influence the decisions and actions of the most important institutions of the European Union.
The situation in which the authorities in Poland openly violate the law, and international institutions, instead of reacting, remain passive, is not only worrying, but also threatens to escalate the rule of law crisis. Poland, as a democratic country, cannot afford to ignore constitutional principles and turn a blind eye to the unlawful actions of the government, especially at such a delicate political moment. The current situation requires firm opposition and action from all responsible institutions, both in Poland and internationally.
